EGAD Saturday Market Vendor Agreement
Terms & Conditions
- Vendor Fee: Each vendor will be charged a fee of $100 for a 10×10 tent space, payable upon acceptance of this agreement. An application fee of $10 dollars is required and we’ll be applied to the vendor fee should the vendor be approved. All fees are non-refundable.
- Setup & Breakdown:
- Vendors must complete setup by 3:30 PM on December 21, 2024.
- No early breakdown is allowed; vendors must stay for the entire event duration, until 9:00 PM.
- Vendor spaces will be assigned upon arrival. Vendors are required to bring their own tents, tables, and displays.
- Permitted Items: This event will only allow vendors selling non-cooked items. Cooking vendors are not permitted.
- Liability & Insurance:
- The Eau Gallie Arts District (EGAD) and associated event organizers are not responsible for any damage, theft, or loss of vendor items or equipment.
- Each vendor is responsible for their setup, products, and any liabilities arising from their participation in the event.
- Vendor Conduct:
- Vendors are expected to operate in a safe, respectful, and professional manner.
- Any vendor deemed to pose a safety risk or who fails to comply with event rules may be removed from the event without refund.
- Parking & Load-In:
- Vendors must unload quickly and relocate their vehicles to street parking areas before 3:30 PM.
- Vendors are responsible for their load-in and load-out without assistance from EGAD staff.
- Permits: Vendors are responsible for any required permits, licenses, and tax obligations related to their participation.
Liability Waiver
In consideration of participating in the EGAD Saturday Market, each vendor hereby agrees to the following:
- I, the undersigned vendor, agree to release, waive, discharge, and covenant not to sue the Eau Gallie Arts District (EGAD), the event organizers, the City of Melbourne, FL, and their agents, officers, and employees (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property during my participation in the event.
- I assume all responsibility for any injury or damage to third parties caused by myself, my employees, or my products, and I understand that I am responsible for providing insurance coverage for these liabilities if I choose.
- This waiver shall be binding upon me, my heirs, executors, and administrators.
